Introduction - ProstoServer Acceptable use policy
At ProstoServer, we provide a wide range of web hosting and internet services, empowering our customers ("Subscribers") and their clients to access and share diverse public, private, commercial, and non-commercial content. We believe the internet should be an open platform for free expression and information exchange. However, in situations where conflicting interests arise, ProstoServer reserves the right to implement necessary actions to balance these interests. To ensure a safe and responsible use of our services, we’ve established this Acceptable Use Policy (AUP). This policy is intended to clarify the rights and obligations of our Subscribers, complementing the terms outlined in their individual service agreements. Please note, this AUP is subject to periodic revisions.
The internet's decentralized nature is both its strength and its challenge. While it offers remarkable accessibility, it also requires that users, including our Subscribers, exercise discretion and responsibility in how they interact with and share content. ProstoServer cannot oversee, verify, or guarantee the accuracy of the vast amount of information available online. Subscribers are advised to use their judgment when engaging with internet content, recognizing that some material may be objectionable or inappropriate. ProstoServer does not monitor, edit, or censor content shared by Subscribers. However, as our network is a conduit for this information, Subscribers are responsible for adhering to legal standards such as copyright laws and defamation rules. Furthermore, the content shared through our services may influence the broader public, affecting our reputation and business. As such, any activity that violates our policy or terms is prohibited and may result in action.
Unsolicited Bulk Email (UBE) or Spam
Sending Unsolicited Bulk Email (UBE), commonly known as spam, through ProstoServer's servers is strictly prohibited. This also includes sending spam from other service providers that advertises any website, email address, or utilizes resources hosted on ProstoServer’s servers. Accounts on ProstoServer cannot be used to solicit customers or collect responses to messages from other Internet Service Providers when those messages violate ProstoServer’s Acceptable Use Policy (AUP) or that of another provider.
Running Unverified Mailing Lists
Subscribing email addresses to any mailing list without the express, verifiable consent of the owner is forbidden. All mailing lists operated by ProstoServer clients must be “Closed-loop” or “Confirmed Opt-in,” with subscription confirmation kept for the duration of the list’s existence. Purchasing email lists from third parties to send messages to any domain or server hosted by ProstoServer is also prohibited.
Misuse of Software, Programs, or Services
Advertising or using any software, program, product, or service that facilitates sending spam or engaging in harmful activities such as initiating denial-of-service (DoS) attacks, flooding, mail-bombing, or pinging, is not allowed.
Spamhaus Register of Known Spam Operations (ROKSO)
ProstoServer does not allow accounts connected with or reselling services to individuals or businesses listed in the Spamhaus Register of Known Spam Operations (ROKSO) database. You can access the database at www.spamhaus.org/rokso.
Unauthorized Access Attempts
Any unauthorized attempt to gain access to accounts or computer resources not belonging to you (commonly known as "cracking") is prohibited. Additionally, any attempt to evade payment for services will be subject to immediate action.
Unauthorized Access or Alteration of Data
ProstoServer strictly forbids any unauthorized access, alteration, or destruction of information belonging to our customers or end-users. This includes attempting to modify or interfere with customer data by any means.
Harassment or Disruption of Service
Engaging in activities designed to harass or disrupt services of other users, whether on the ProstoServer network or elsewhere, is not permitted. This includes performing synchronized number sequence attacks or any denial-of-service attacks.
Interfering with Network Services
Using ProstoServer’s services to interfere with or disrupt the use of the network by other customers or users, either on our network or through another provider, is prohibited.
Audio/Video Streaming
ProstoServer’s services are not designed to support audio or video streaming. As such, streaming audio or video content is not allowed on our platform. Accounts found in violation of this policy will be suspended without prior notice, or may even face termination.
Adult-Oriented Content
While ProstoServer allows adult content in compliance with applicable laws, any account found to be violating the laws of the United States or any other applicable jurisdiction will face suspension or termination. We enforce strict adherence to legal standards to maintain a responsible hosting environment.
Large File Policy
ProstoServer’s services are not intended for file hosting or distribution, especially for files larger than 50MB. Files primarily intended for download, such as large audio/video files, .EXE, or .ISO files, are prohibited. Obscene Speech or Materials
We do not tolerate the use of ProstoServer’s network for promoting, transmitting, storing, or displaying child pornography or obscene materials. As part of our legal obligations, any such content detected on our network will be reported immediately to the appropriate law enforcement agencies.
Defamatory or Abusive Language
ProstoServer's network should not be used to transmit, post, or distribute abusive, defamatory, threatening, or harassing language. This includes the manipulation or forging of message headers to mislead or conceal the true source of a message. We are committed to maintaining a respectful and secure environment for all users.
Usenet Groups
ProstoServer reserves the right to refuse content postings from newsgroups that we determine to be in violation of this Acceptable Use Policy (AUP). If we find substantial evidence of a violation, we will take action to protect our network and users.
Distribution of Destructive Software or Activities
The distribution of viruses, worms, Trojan horses, or any other harmful software intended to disrupt, damage, or otherwise negatively impact the network is strictly forbidden. Similarly, activities such as pinging, flooding, mail bombing, or denial-of-service attacks are prohibited. Our primary goal is to ensure a stable and secure environment for all users.
Unauthorized Access or Hacking
Accessing or attempting to access computers, accounts, or networks that you are not authorized to use is a serious violation of ProstoServer’s policies. This includes hacking attempts, port scanning, stealth scanning, or any actions that may compromise the security of another system. ProstoServer is committed to preventing unauthorized access and protecting our customers' security.
Facilitating a Breach of This AUP
Offering, transmitting, or promoting software, programs, products, or services that are specifically designed to breach this Acceptable Use Policy (AUP) is strictly prohibited. This includes any actions that support spamming, initiating pinging or flooding, mail bombing, launching denial-of-service attacks, or engaging in software piracy. We are committed to maintaining a safe and responsible environment for all users and will take immediate action if this policy is violated.
Violations of Export Controls
The transmission of encryption software or any related products outside the United States, whether over the Internet or by other means, is not allowed. We comply with all applicable export control laws, and violations of these laws may result in severe consequences.
Other Activities
Any activity, lawful or unlawful, that ProstoServer deems harmful to its subscribers, operations, reputation, goodwill, or customer relationships is strictly prohibited. Subscribers are primarily responsible for avoiding such behaviors. While ProstoServer does not routinely monitor communications to ensure policy compliance, if harmful activities are detected, we reserve the right to take necessary actions. These actions may include removing information, disabling websites, implementing blocking measures, or denying Internet access. ProstoServer recognizes that many subscribers offer Internet services to their own customers. However, subscribers are not required to monitor or censor content created by their customers. If the activities of a subscriber’s customer cause harm to others, ProstoServer reserves the right to take corrective actions directly against that customer or the subscriber. We expect full cooperation from all subscribers when taking necessary preventive or corrective measures.
ProstoServer will not intentionally monitor private email communications unless required by law, government authorities, or if public safety is at risk. However, we may monitor our network to ensure that services are running smoothly. If required by law, ProstoServer may disclose subscriber information in response to a court order, subpoena, or any legal request. In some cases, we may not be legally permitted to inform the subscriber of such disclosures. Our commitment to privacy means we will not sell or share subscriber information with external companies. Subscribers are responsible for complying with all privacy laws concerning online communication. Any violation of this policy will result in appropriate action. If a subscriber’s or their customer's actions lead to a loss for ProstoServer or result in legal claims, the subscriber will be held responsible for any damages, associated costs, or legal fees incurred. The purpose of this AUP is to clarify the responsibilities of all users and to ensure a safe and secure online environment.
